Terms of Service

These terms govern every purchase made in this store and every use of this website. Please read them before you order. If you are a consumer, nothing in these terms limits the rights the law gives you.

1. Who you are contracting with

“We”, “us” and “our” mean EVERLINE GmbH. “You” means the person using this website or placing an order. A consumer is a natural person entering into the contract for purposes outside their trade, business or profession (§ 13 BGB). An entrepreneur is a person acting in the exercise of their trade, business or profession (§ 14 BGB).

2. Scope

These terms apply in the version valid at the time of your order. Your own general terms and conditions do not apply unless we have agreed to them in writing.

3. How a contract comes about

The presentation of products in this store is not a binding offer. It is an invitation to you to place an order.

1. You put products into the cart and open the checkout.
2. You enter your delivery and payment details. You can review and correct everything before the final step, using the back button of your browser or the edit links shown at checkout.
3. You place a binding order by clicking the order button, which is labelled in a way that makes the payment obligation clear.
4. We confirm receipt of your order by email. This confirmation is not yet an acceptance of your order.
5. The contract is concluded when we send you the dispatch confirmation, or when we deliver the goods, whichever happens first. If we cannot accept your order, we will tell you promptly and refund any payment already made.

4. Contract language and storage of the contract text

Contracts can be concluded in English and in German. We store the text of your order and send you the order details by email. You can also view past orders in your customer account, if you have one.

5. Prices and payment

Prices shown to customers in the European Union include statutory VAT. Shipping costs, and any customs charges for deliveries outside the EU, are shown separately as described in our shipping policy.

The price that applies is the price displayed at the time you place your order and stated in your order confirmation. Promotions can be changed or ended at any time; this never changes the price of an order already placed.

The payment methods available to you are shown at checkout. Payment is due when the order is placed unless a different arrangement is shown at checkout.

6. Retention of title

The goods remain our property until payment has been received in full (§ 449 BGB).

7. Delivery and passing of risk

Delivery times are estimates and not guaranteed dates; our shipping policy sets them out. If you are a consumer, the risk of accidental loss or deterioration passes to you only when the goods are handed over to you (§ 475 (2) BGB). If you are an entrepreneur, risk passes when we hand the goods to the carrier.

8. Right of withdrawal

If you are a consumer you have a statutory right of withdrawal of 14 days, and we grant a voluntary right of return of 99 days on top of it. The full withdrawal instructions and the model withdrawal form are set out in our refund policy, which forms part of these terms.

9. Warranty and guarantee

Statutory rights in respect of a lack of conformity apply (§§ 434 ff. BGB). For consumers these rights can be asserted for two years from delivery and are free of charge. For entrepreneurs the limitation period is one year from delivery and § 377 HGB applies.

In addition we give a voluntary lifetime guarantee on the body of EVERLINE ONE. Its exact scope is set out in our refund policy. A voluntary guarantee never limits or replaces statutory rights.

10. Our products

We take care to show our products accurately. Colours and surface finishes can still look different on your screen depending on your device and its settings. We may change product descriptions and discontinue products; this never affects an order already accepted.

11. Your account

You may open a customer account. Keep your login details safe and do not pass them to anyone else. You are responsible for activity carried out with your credentials. The information you give us must be correct and current. You may not transfer or sell your account.

12. Acceptable use

You may use this website for lawful purposes only. In particular, you may not use it to break any law, to infringe our rights or those of others, to harass any person, to send unsolicited advertising, to impersonate anyone, to upload malicious code, to scrape or copy the store, or to interfere with its security. We may suspend or close an account used in this way.

13. Intellectual property

All content on this website — text, images, video, product photography, designs, the EVERLINE name and logo — belongs to us or to our licensors and is protected by copyright and trade mark law. You may use the website for your own private purposes. Any reproduction, distribution, modification or public use beyond that requires our prior written consent. Shopify’s name and logo are trade marks of Shopify. All other marks belong to their respective owners.

14. Reviews and other content you send us

If you send us a review, a photo, a suggestion or other content, you grant us a non-exclusive, worldwide, royalty-free right to use it in connection with our products and our marketing. You confirm that the content is yours to give and that it infringes no one’s rights. We may remove content that is unlawful, abusive or misleading. We are not obliged to publish or to respond to anything you send.

15. Third-party tools and links

This website may link to, or embed, services operated by third parties. We do not control them and are not responsible for their content. Please read their terms and privacy notices before you use them.

16. Relationship with Shopify

This store runs on Shopify. Every purchase you make here is a contract between you and EVERLINE GmbH. Shopify provides the platform, is not a party to that contract and is not responsible for the products.

17. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act, and to the extent that we have given a guarantee.

For a slightly negligent breach of a material contractual obligation — an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely — our liability is limited to the foreseeable damage typical for this type of contract.

Any further liability is excluded. This does not alter the burden of proof to your disadvantage. These limitations apply equally to the personal liability of our staff and agents.

19. Consumer dispute resolution

The European Commission’s Online Dispute Resolution platform ceased operations on 20 July 2025. Pursuant to § 36 VSBG we are neither obliged nor willing to participate in proceedings before a consumer arbitration board. Please write to info@geteverline.com and we will try to resolve the matter with you directly.

20. Governing law and place of jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence (Art. 6 (2) Rome I Regulation).

If you are a merchant, a legal person under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is Passau, Germany.

21. Changes to these terms

We may update these terms. The version that applies to your order is the one in force when you place it. The current version is always available on this page.

22. Severability

If a provision of these terms is or becomes invalid, the remaining provisions stay in force.
